Mountaineering Joe accepts bookings subject to the following terms and conditions:
The Agreement
Whether you book as an individual or a group, we will deal with the lead booking name in all subsequent correspondence, which includes, confirmation of booking, changes, amendments and cancellations.
On receipt of your booking enquiry form, we will contact you to confirm your booking and details and issue a ‘Booking Agreement’ and an invoice. Your booking will only become confirmed upon receipt of payment. Once confirmed, we will issue your course/activity itinerary, details, kit list and other useful information. If any details on the Booking Agreement and invoice are incorrect please tell us immediately.
You (also applies to each group booking member) are responsible for ensuring the accuracy of the personal details or any other information supplied in respect of yourself, to Mountaineering Joe.
You should be adequately insured for the course/activity you are undertaking. For courses/activities held abroad you must have appropriate insurance and we will require a copy of your insurance policy confirmation.
It is your responsibility to be at the location for the proposed course/activity on time with the appropriate personal clothing and personal equipment. Contact us if you have any queries.
Age Restrictions
Our minimum age limit is 18 years of age, there is no upper age limit but it should be noted that you are undertaking physical and sometimes challenging activities. Children aged 13 years and upwards are only accepted if a parent or legal guardian has booked and is attending the course/activity with the child.
Payment
UK Courses and Activities
If you are booking 4 weeks (28 days) or more prior to the start of your course/activity date, you may pay for the total cost in full, or pay a deposit of:
- £75.00 deposit for UK based courses up to 4 days duration or less.
- £100.00 deposit for UK based courses between 5 and 7 days duration.
All balances must be paid, in full, 4 weeks (28 days) prior to the commencement of the date of the course/activity to secure the booking.
If a booking is made within the 4 week (28 day) period, prior to the start of the course/activity, the whole payment must be submitted on booking to secure the booking
Overseas Courses and Activities
If you are booking more than 8 weeks (56 days) prior to the start of your course/activity date, you may pay for the total cost in full, or pay a deposit of
- 50% of the total fees as a deposit for overseas courses/activities.
All balances must be paid, in full, 8 weeks (56 days) prior to the commencement of the date of the course/activity to secure the booking.
If a booking is made within the 8 week (56) period, prior to the start of the course/activity, the whole payment must be submitted on booking, to secure the booking
Corporate Bookings
If you are booking 8 weeks (56 days) or more prior to the start of your course/activity date, you may pay for the total cost in full, or pay a deposit of:
- 50% of the total cost due is payable on booking, if you are booking 8 weeks (56 days) or more prior to the start of your course/activity.
All balances must be paid, in full, 8 weeks (56 days) prior to the commencement of the date of the course/activity to secure the booking.
If a booking is made within the 8 week (56 day) period, prior to the start of the course/activity, the whole payment must be submitted on booking, to secure the booking.
If You Cancel Your Booking – UK Courses and Activities
If you want to cancel your booking, you must contact us as soon as possible. All cancellations must be made in writing to Mountaineering Joe. Once your booking has been cancelled you will receive a ‘cancellation invoice’ confirming the fees payable. Please note, that in all cases deposits are non-refundable.
- Where cancellation takes place 14 days, or less, from the start date of the course or activity, 100% of the total course/activity fee is payable.
- Where cancellation takes place on or after the commencement date of the course or activity, 100% of the total course/activity fee is payable.
- Where cancellation takes place 15 days, up to and including 28 days, from the start date of the course or activity, 50% of the total course/activity fee is payable.
- Where cancellation takes place 29 days or more, from the start date of the course or activity, the loss of the deposit, is the penalty. You may have an option to reserve a place on another course/activity subject to availability under this option.
If You Cancel Your Booking – Overseas and Corporate Courses and Activities
- Where cancellation takes place 28 days, or less, from the start date of the course or activity, 100% of the total course/activity fee is payable.
- Where cancellation takes place on or after the commencement date of the course or activity, 100% of the total course/activity fee is payable.
- Where cancellation takes place 28 days, up to and including 56 days, from the start date of the course or activity, 50% of the total course/activity fee is payable.
- Where cancellation takes place 56 days or more, from the start date of the course or activity, the loss of the deposit, is the penalty. You may have an option to reserve a place on another course/activity subject to availability under this option.
If Mountaineering Joe Cancels Your Booking
We aim to provide your course/activity as booked. Mountaineering Joe will make every attempt to ensure that courses and activities run. We will notify you of any cancellation of a course or activity as soon as practicable, where it believes that cancellation is necessary due to a ‘Force Majeure’ (an event beyond our control, such as war, riots, disturbances, terrorist activity, natural disasters, actual or potential severe weather conditions, and any other similar events).
We will notify you of the cancellation not less than 5 days prior to the commencement of a course or activity, where numbers, as a result of either other Client(s) cancellations or booked numbers have failed to reach a workable minimum. In the event of a cancellation by us, you will be offered the choice of the following options:
- A full refund of the fee paid; or
- Another booking on a different date.
If You Change Your Booking
You must ensure that all the details provided on booking are correct. When you book you will receive a Booking Agreement and invoice and you must contact us straight away if there is something that needs correcting. If you need to change your course/activity date/s within the 4 week (28 day) period (0r 8 week, 56 day period as appropriate) prior to the start of your course or activity, this will be dealt with under the terms and conditions relating to cancellation by you.
You may transfer your booking to another person (substitute person), provided that the following conditions are met:
- You authorise the change in writing
- The substitute person accepts the transfer, complies with the terms of the existing booking and our terms and conditions
- The substitute person has appropriate insurance that covers cancellation and the course/activity they are undertaking.
If Mountaineering Joe Changes Your Booking
We hope that we will not have to make any changes to your booking. We make every effort to ensure the accuracy of our literature. However, changes can occur despite our best endeavours and we reserve the right to change any price or particulars before a booking is confirmed.
If there is a ‘Major Change’ (a change of more than 75%) to a confirmed booking we will inform you as soon as is reasonably practicable. We will offer you the choice of accepting the change, receiving a full refund, or transfer to another available date.
If you choose to cancel and the ‘Major Change’ was not caused by a ‘Force Majeure’ or low bookings, we will pay you reasonable compensation, if appropriate, having regard to the nature of the change and length of notice given.
If we become unable to provide a major proportion of a booked course/activity, we will make every effort to make/offer alternative arrangements at no extra charge, where appropriate.
Course Content, Acceptance of Authority and Influential Factors (weather, your physical fitness, health and conduct)
Mountaineering Joe literature and website content are designed to be illustrative and explain the scope and type of courses/activities you will be undertaking. It is very unlikely that any one course/activity could or would be followed precisely as it is published. Factors outside of our control will determine this and dictate what can be reasonably accomplished. The most influential factor’s are: the weather; and your physical fitness. The guide/instructor will construct the best course/activity possible, taking into account, the aims of the course/activity, your aims and aspirations, your physical fitness and prevailing weather conditions.
A confirmed booking signifies your acceptance of the guide/instructors’ authority to make decisions affecting you, other individual’s or the group.
You may be requested to leave the course if it is deemed that: your health may be at risk; you are not coping; you may not cope with the demands of the course; an illegal act has been or may be committed; or conduct is detrimental to the safety, enjoyment or well being of an individual or the group. You must refrain from any conduct which may give offence or cause danger or damage to any person or property.
You confirm that you are in good mental and physical health and are unaware of any reason why you may be unsuited to the course/activity you have booked. It must be recognised that courses contain an element of risk beyond the control of Mountaineering Joe.
Disclosure of Information – Your Details
If you fail to disclose any information that is required on the booking enquiry form, Booking Agreement form and during the booking process, this may result in Mountaineering Joe terminating the contract, and withdrawing you from the course/activity on the grounds of incorrect information. In this instance, you will not be entitled to any refund of payments under this termination of contract.
Complaints
You must report, in the first instance, to Joseph Begley (or the instructor in charge, if it is not Joseph Begley), any problems that arise during the course/activity. We will endeavour to resolve any issues immediately. If a complaint is not resolved at that time and you wish to raise a complaint, full written details must be sent to the Mountaineering Joe, at Tai Lein, 6 Railway Cottages, Llangaffo, Gwynedd, Isle of Angelsey, LL60 6LP within 28 days of the course completing. Include your booking reference number, your details and the exact and full details of your complaint. You may prejudice our ability to resolve your problem and/or investigate it fully if you fail to take these steps and any right to compensation you may have had will be lost or substantially reduced.
Conditions of Service
As part of the Mountaineering Joe continual review of safety and associated considerations, the terms and conditions of booking are subject to change, clarification and modification at any time. All courses, itineraries, activities and days out are subject to weather conditions. The instructors choice of location will be dependent on the prevailing weather conditions and clients ability and experience.
Law and Jurisdiction
This agreement is made in accordance with the laws of England and Wales. The Courts of England and Wales shall have exclusive jurisdiction in relation to any matters arising out of this Agreement.
British Mountaineering Council (BMC) Participation Statement
‘The BMC recognises that climbing and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement. All participants must be aware of this and accept the risks associated with these activities. Personal Accident and Cancellation Insurance is highly recommended.’
